Aand Res A mediation

The whole of the mediation took place in one session as it had been very difficult to arrange date mutually convenient to both parties.  It was deceided that following conversations with each party, it would be appropriate to conduct the mediation in this way. 

The party1 had asked the court if the case could go to mediation following a court hearing, and it was duly agreed.  This however had been agreed in the Summer of 2005 and it had taken until early Feb 2006 to arrange for this to happen.

The process was explained to party 1 during the introductions of the first meeting.  She appeared to be extremely nervous and both mediators worked hard to try and reduce that feeling for her.  Confidentiality was explained at the same time.  Prior to the meeting, mediators had had sight of various documents that had passed between both parties, however it was needed for party 1 to explain what had happened for the case to get to the present position. 

Party A is landlord who has a tenatnt in her flat, party 2 are representatives of the residents association who manage the block.  There had been some damage to the roof and party A had asked for repairs to be done as the interior of the flat was suffering from damp.  It had taken two years for the work to be done and party A had contracted the work to be done, but deducted payment from the maintenance payments to the residents association.  Party 2 are now demanding that money to be paid and interested is being added whilst the debt is outstanding.   Party A  claimed that she had undertaken this procedure in the past and there had been no objection.  This time she had been told to claim from the resident's associations insurance company!!!!!!!!!!!!  However there was some argument from the insurance company over this as they claimed that partyA had been paid the money for the repair.

Party 2 were claiming that they were within the lease agreement to ask that monies be paid or all the residents in the block would have the shortfall divided between them. 

The matter was discussed over a long period of time, however the agreement made was to proceed to arbitration.  There was no shift on either side.

TLC Steepleview

TLC Steeple view

This was the second visit and I was sure that like before it was not going to be easy.  There were extra people present and from the start S the main speaker made her points by being confrontational.  It left very little for anyone else to get their say.  Party 2, the son, would not engage at all, despite my coaxing him into the conversation.

Party 1, S, became more excitablle as the time wore on.  There were clear issues that were more to do with her partner than party 2. 

It was obvious that this further meeting was not appropriate for mediation at that time.  I believe that mental health support was needed for party1, followed up by mediation.

201205mediation

Went to an interesting TLC mediation last night.  Clients included Y/P, grandmother and partner and also Y/P mum.

Grandmother spoke first to outline the issues.  Y/P had been living with her for about 1 month since mother had thrown Y/P out because of an assault.  Y/P has had previous mental health issues.  Hd been badly bullied at school and spent one year having in-house mental health treatment.  Was now on mediacation for depression since her move.  The Y/P mental health issues had previously been well managed and monitored but since moving there has been no support in this area.

Y/P was contantly interrupting when other people were having their say.  This was challenged.  I believe the Y/P felt that she was being blamed for what had happened.  There was clearly alot of anger.  Meidatirs were also told that Y/P was drinking alcohol whilst taking prescription drugs despite being asked not to do so. 

Mum's body language suggested she was at the end of her tether despite wanting to help and loving her child.  Y/P interrupted Mum all the time and found it difficult to let her speak.  Y/P is now in bed and breakfast as a result of an attack the week before.  However Y/P does not feel comfortable with that situation and would like to be at home.

Mediations

Have so far undertaken two mediations this week.  The initial visits for a neighbour mediation and a full Y/P mediation.

The neighbour mediation was concerning noise and I believe that it was going well and that all the points had been covered with party 1 agreeing at first to a full mediation meeting.  At the last moment, the party changed her mind and would not agree to going any further.  Party 2 were very interested in going to a full face2 face.

Decided to see if I could turn the situation around as I fully believed that face 2 face would really work well in this situation. However it was not to be as party1 became abusive and angry when I spoke to her.  This case will be closed.

The Y/P mediation went very well with both parties fully participating.  there were notes of thanks to each other, apologies and the young man reassured his Mum that he did love her.  However, and it is a big one, I believed there was an issue that was not discussed and it was the very reason that the young man was referred for mediation.  It may be that there will be anothre session where this can happen.   A's support worker was very positive about the session and fedback that it had gone very well.

Presentation

I'm using each new area of work I undertake as a learning opportunity.  Today I had to give a presentation to GDC, I havent done many before so I used some NLP skills to help me get through it.  In other words, I became that skilled presenter forgetting to be too nervous and remembering the information I was required to get across.  It was really useful snd I am anxious to read some more so that I can use the skills again and at higher level.  I really need to get onto a course as I believe that what I can learn will be very useful to BM in the future. 

I observed some of our new volunteer mediators doing a full mediation yesterday, they were very good.  The meeting showed signs of getting out of hand and they succeeded in keeping control of the situation.  Parties reached an agreement but I am doubtful whether it will hold as one party was xtremely confrontational most of the time, des[ite saying that she wanted respect.  Interesting.

Brentwood mediation 2nd meeting

I am beginning to notive a pattern that seems to occur when a second TLC meeting is held, the parties seem to get stuck.  Following our first visit, the feedback I got was very positive, that the parties were beginning to open up and discuss some of the issues that had arisen to get them to their present position.  However during our second visit, J was not in any mood to respond to anything. 

An incident had occured during the week that had been an invasion of one of the party's privacy  and it was demonstrated that it was not acceptable, however it was not demonstrated directly to the party who alledgedly did it.  ( Lack of communication.) There was just an extremely bad atmosphere. 

he parties had been asked to come up with some possible suggestions that might be a way to moving the situation forward.  This they had done regarding finances, and space but as for the relationship issues, they had not been addressed.

The visit lasted just over 2 hours with little progrees being made at the end.  It was decided to end the meeting to give some time for reflection and that I would call back early next week to see if another visist was required or if any moves had been made.

Mediation

Okay, so what did I learn from Thursday's mediation.   

The meetings were introduced in the correct way.
We got party 1's view of the situation although due to her age it may have been a little confused.
Party 2 finds it difficult to understand she is doing anything other than day to day living.
May be a relationship issue such as jealousy or lifestyle of one party has changed.
We will undertake shuttle phone mediation due to party 2's age.

prty 2 is very aggrieved that she has an ASBO that could be served on her tenanacy.  This needs to be resolved.

Full week

Its been a very full week, lucky I am at home today.  Spent yesterday in London talking to TCM.  Will not know until laternext week if it will be useful to me.  If it has then I will have decisions to make about my future.  It makes things look not quite so bleak where I am although it may only be for the short- term.

Have really been using some of the skills I learned during the 6 days mediation training.  Have managed to get far more people to mediation. Could be because I have changed my approach in that I also feel more comfortable and confident in what I ma saying to clients.  Just having those skills  affirmed has helped.

Also got some feedback from Tuesdays mediation clients which was very positive.  Looks like good stuff! 

Not too sure about the course work I have to complete.  Seems a bit muddled and not clear.  Will have to spend a bit of time soering it out.  I believe the manual is not that helpful to my studies.

End of training

Still not fed up with the colour. 

Well we came to the end of 6 days of workplace mediation training. I believe I have really filled in the gaps left by previous work and my practice has changed.

 
 I am able to deal with telephone calls with far more confidence as I begin the mediation process from that moment.  As soon as the conversation begins I use active listening, rephrasing , reframing and summing up.  Its brilliant clients sound as if they know they have been listened to and respond with more willingness to have an initial meeting with mediators.  I believe that taking notes will help during a full mediation providing clients agree, as from the notes, I will be ale to sum up far more accurately.  I used this during training and it was much easier to find the commonality between parties .  The commonalitys provided the level playiong field from which to work during the full mediation.  Once parties beging to realise what the common ground is, a shift from position to interests becimes very apparent.( We all have some common interests.)

I am now waiting to put my improved skills into practice on Tuesday when I have my first face to face mediation.

I have to prepare for my interview on Thursday, I am very nervous as I would like to be successful.  Feels as if things have moved forward very quickly in the last three weeks. 

A contacted me regarding a particular event and I had the opportunity for a long chat.  She gave me lots of encouragement.

Workplace mediation training

What a fantastic day.  I met 11 people from very varied working backgrounds and with vrey different experiences and we formed a workplace mediation training group.  I began to realise hpw much I dont know about mediation and how much I will need to know in order to become an effective mediator. 

We learned what mediation is.
What skills and qualities are required to be a mediator.
We demonstrated what conflict looks like, so very visual.
How mediation benefits organisations.
What would be the ground rules of how the group will work together.
Diversity.

We looked at the usefulness of reflection in learning to mediate, and , here I can refer to Schon and Argyris reflective cycles of learning.

Discovery Learning

Jerome Bruner was influential in defining Discovery Learning. It uses Cognitive psychology as a base. Discovery learning is "an approach to instruction through which students interact with their environment-by exploring and manipulating objects, wrestling with questions and controversies, or performing experiments" (Ormrod, 1995, p. 442) The idea is that students are more likely to remember concepts they discover on their own. Teachers have found that discovery learning is most successful when students have prerequisite knowledge and undergo some structured experiences.
